  1. Card 1

  26. Card 26

What is the primary distinction between a 'rechtsfeit' (legal fact) and a 'rechtshandeling' (legal act)?

A 'rechtsfeit' is any fact to which objective law attaches legal consequences, regardless of intent. A 'rechtshandeling', on the other hand, is a specific action taken with the explicit intention of creating legal consequences.

  27. Card 27

Explain why every legal act ('rechtshandeling') is considered a legal fact ('rechtsfeit'), but not every legal fact is a legal act.

Every legal act is a legal fact because it is an event to which the law attaches consequences. However, not every legal fact is a legal act because some legal facts, like birth or death, occur without the conscious intent to create legal consequences, unlike a legal act such as entering into a contract.

  28. Card 28

Define 'publiekrechtelijke rechtshandeling' and provide an example.

A 'publiekrechtelijke rechtshandeling' is a legal act established by the government or public authorities. An example is the city of Hasselt renting a building to house municipal archives, or the issuance of a law by parliament.

  29. Card 29

What are the two main subdivisions of 'publiekrechtelijke rechtshandelingen'?

The two main subdivisions are norm-setting legal acts, such as the promulgation of a law, and individual legal acts, like the appointment of a civil servant or an expropriation.

  30. Card 30

How does a 'privaatrechtelijke rechtshandeling' differ from a 'publiekrechtelijke rechtshandeling'?

A 'privaatrechtelijke rechtshandeling' is a legal act performed by natural persons or private entities, such as a student renting a room. In contrast, a 'publiekrechtelijke rechtshandeling' is performed by the government or public authorities.

  31. Card 31

Distinguish between a 'eenzijdige rechtshandeling' and a 'meerzijdige rechtshandeling' based on the number of parties involved.

A 'eenzijdige rechtshandeling' requires the declaration of will from only one person, such as terminating a rental contract or drawing up a will. A 'meerzijdige rechtshandeling' requires the agreement of will between two or more persons, like entering into a rental agreement or a friendly settlement for a traffic offense.

  32. Card 32

Explain the concept of 'vestigende rechtshandelingen' and give an example.

'Vestigende rechtshandelingen' are legal acts that establish new rights and obligations. An example is marriage, which establishes new rights and duties like cohabitation and fidelity, or adoption, which creates new rights and duties such as the right to child benefits and maintenance obligations.

  33. Card 33

What are 'overdragende rechtshandelingen', and how do they function?

'Overdragende rechtshandelingen' are legal acts that transfer existing rights from one person to another. For instance, in a purchase contract, ownership rights are transferred, and in a rental contract, the right to use and enjoy the property is transferred.

  34. Card 34

Describe 'aanwijzende rechtshandelingen' and provide an illustration.

'Aanwijzende rechtshandelingen' are legal acts that confirm a legal status without creating new rights. An example is the division of an inheritance among heirs, or the written confirmation of an orally concluded agreement.

  35. Card 35

What is the difference between 'vormelijke rechtshandelingen' and 'vormvrije rechtshandelingen'?

'Vormelijke rechtshandelingen' require specific formalities, such as an authentic deed for a marriage contract or a donation. 'Vormvrije rechtshandelingen' do not require such formalities; a simple agreement of will is sufficient, as seen in a purchase contract.

  36. Card 36

What is the first essential validity requirement for a legal act, and what are its potential defects?

The first essential validity requirement is 'wilsovereenstemming' (agreement of will), meaning there must be at least one expression of will that is not affected by a 'wilsgebrek' (defect of consent). Potential defects include error ('dwaling'), fraud ('bedrog'), coercion or violence ('geweld of dwang'), and undue influence ('benadeling').

  37. Card 37

Define 'dwaling' (error) as a defect of consent and explain the condition for it to lead to nullity.

'Dwaling' occurs when contracting parties have an involuntary incorrect understanding of reality, such as mistakenly buying a used car believing it to be new. For it to lead to nullity, the error must be 'verschoonbaar', meaning a normally cautious person in the same circumstances would also have made the same mistake.

  38. Card 38

What is the consequence if a legal act is found to be affected by a defect of consent like 'dwaling' or 'bedrog'?

If a legal act is affected by a defect of consent, a judge can declare the legal act null and void. This means that the legal act is treated as if it never existed.

  39. Card 39

What is the second validity requirement for a legal act, and who falls into the categories of 'handelingsonbekwaam' (legally incompetent)?

The second validity requirement is the 'bekwaamheid van partijen' (capacity of parties), meaning the parties must be legally competent to perform a legal act. The two categories of 'handelingsonbekwaam' are individuals with mental illness (e.g., dementia) and minors.

  40. Card 40

Explain the third validity requirement for a legal act concerning its 'voorwerp' (object).

The third validity requirement is that the legal act must have an 'voorwerp' (object) that is determinable and lawful. 'Geoorloofd' means the object must not be contrary to public order or good morals, for example, a contract for surrogacy is considered contrary to public order and good morals.

  41. Card 41

What is the fourth validity requirement for a legal act regarding its 'oorzaak' (cause)?

The fourth validity requirement is that the legal act must have a lawful 'oorzaak' (cause). This refers to the reason why one enters into a legal act, and this reason must not be contrary to public order or good morals, such as a sham marriage.

  42. Card 42

Define 'rechtsmisbruik' (abuse of rights) and state the general principle behind it.

'Rechtsmisbruik' occurs when rights are not exercised within legal limitations and with due care. The general principle is that rights may not be exercised without regard for legal restrictions and the 'zorgvuldigheidsnorm' (duty of care).

  43. Card 43

What are the three criteria used to determine if 'rechtsmisbruik' has occurred?

The three criteria are: 'oogmerk om te schaden' (intent to cause harm), 'afwezigheid van belang' (absence of personal interest in exercising the right), and 'kennelijk onredelijke rechtsuitoefening' (manifestly unreasonable exercise of a right where the benefit is disproportionate to the harm caused to the other party).

  44. Card 44

What are the potential sanctions for 'rechtsmisbruik'?

The potential sanctions for 'rechtsmisbruik' are 'herstel in natura' (restoration to the original state) or 'schadevergoeding' (damages).

  45. Card 45

Distinguish between 'politieke rechten' and 'burgerlijke rechten' within the classification of subjective rights.

'Politieke rechten' are rights that citizens can invoke against the government, such as freedom of speech or the right to vote. 'Burgerlijke rechten' are rights that citizens can invoke against other citizens, covering aspects like privacy, family relations, and property.

  46. Card 46

Explain the difference between 'extra-patrimoniale rechten' and 'patrimoniale rechten' as categories of 'burgerlijke rechten'.

'Extra-patrimoniale rechten' are rights not connected to a person's assets and are not easily quantifiable in money, such as personality rights (right to privacy) and family rights (right to lineage). 'Patrimoniale rechten' are rights connected to a person's assets and are quantifiable in money, including real rights, claims, and intellectual property rights.

  47. Card 47

Why can 'extra-patrimoniale rechten' not be sold, either during life or after death?

'Extra-patrimoniale rechten' are inherently linked to an individual's personality or family status and are not considered part of their transferable assets. They are fundamental rights that protect aspects of human dignity and identity, making them inalienable.

  48. Card 48

What are the four types of 'intellectuele rechten' (intellectual property rights) mentioned in the source material?

The four types of intellectual property rights are 'auteursrechten' (copyrights) for artistic creations, 'tekening en modellenrecht' (design rights) for applied art, 'merkenrecht' (trademark rights) for commercial creations, and 'octrooirechten' (patent rights) for technical and industrial inventions.

  49. Card 49

Define 'publiek recht' and 'privaatrecht' and explain their primary focus.

'Publiek recht' regulates the relationship between citizens and the government, as well as between government institutions themselves. 'Privaatrecht' regulates the relationships between citizens among themselves, primarily based on the principle of freedom to contract.

  50. Card 50

How can the government act within the sphere of 'privaatrecht'?

The government can also act within the sphere of 'privaatrecht' by participating in private legal transactions, such as buying or selling goods, which are activities governed by private law.

  51. Card 51

Define 'vennootschapsrecht' and list the different legal forms of companies recognized since the law of March 29, 2019.

Vennootschapsrecht encompasses the rules concerning the establishment, organization, and operation of companies. Since the law of March 29, 2019, the recognized legal forms are limited to NV (naamloze vennootschap), BV (besloten vennootschap), CV (commanditaire vennootschap), and the maatschap.

  52. Card 52

Explain the dual nature of 'sociaal recht' as a mixed branch of law.

Sociaal recht is considered a mixed branch because it belongs to both public and private law. It regulates the relationships between employer and employee (arbeidsrecht), which has private law aspects, and compulsory social insurances for employees and self-employed individuals (sociaal zekerheidsrecht), which has public law aspects, such as unemployment benefits.

  53. Card 53

Distinguish between 'individueel arbeidsrecht' and 'collectief arbeidsrecht'.

Individueel arbeidsrecht governs the relationship between a single employer and employee, covering aspects like employment contracts, work regulations, and wage protection. Collectief arbeidsrecht, on the other hand, deals with the relationships between groups of employers and groups of employees, such as collective labor agreements (CAO) and joint committees (PC).

  54. Card 54

What is the primary function of 'sociaal zekerheidsrecht' and what types of benefits does it encompass?

Sociaal zekerheidsrecht primarily encompasses rules related to income-supplementing and income-replacing benefits. Income-replacing benefits include pension and invalidity payments, while income-supplementing benefits include holiday pay for employees, which can be income-replacing for laborers who are not paid during their holidays.

  55. Card 55

What is the role of a 'syndicale afgevaardigde' and where do they fit within labor relations?

A syndicale afgevaardigde is an individual designated to represent the trade union, serving as a point of contact for employees to ask questions about their employment contracts, such as unpaid overtime. They play a crucial role in collective labor relations by representing the interests of a group of employees.

  56. Card 56

Define 'Grondwettelijk recht' and identify its main source.

Grondwettelijk recht consists of rules concerning the organization and functioning of the Belgian State, as well as the fundamental rights and freedoms of its citizens. Its main source is the Grondwet (Constitution).

  57. Card 57

What is 'Administratief recht' and what key areas does it regulate?

Administratief recht, also known as bestuursrecht, regulates the organization and functioning of the administration or the executive power. It covers areas such as the organization and operation of central and local government services, the status of civil servants, expropriations, spatial planning, urban development, public procurement, and control over the administration.

  58. Card 58

Explain the concept of 'Fiscaal recht' and provide examples of direct and indirect taxes.

Fiscaal recht comprises rules regarding the levying of taxes to fund the state treasury. Direct taxes are based on income, such as personal income tax. Indirect taxes are not levied on income, examples include VAT (usually 21%), registration tax (paid on the purchase of immovable property), and inheritance tax (paid on an inheritance).

  59. Card 59

Describe the 'territorialiteitsbeginsel' as a characteristic of fiscal law.

The territorialiteitsbeginsel (territoriality principle) in fiscal law means that taxes apply to a specific area or territory. This can include federal taxes, municipal taxes, or taxes that only apply to a particular region, indicating that tax obligations are geographically bound.

  60. Card 60

What does the 'wettelijkheidsprincipe' entail in the context of fiscal law?

The wettelijkheidsprincipe (principle of legality) in fiscal law, as stated in Article 170 of the Constitution, dictates that taxes can only be levied if they are established by law. This ensures that taxation is based on legal provisions and prevents arbitrary imposition of taxes.

  61. Card 61

Explain the 'verbod van privileges' in fiscal law.

The verbod van privileges (prohibition of privileges) in fiscal law, as stipulated in Article 172 of the Constitution, means that everyone must pay taxes and there should be no special advantages or exemptions. This principle ensures equality before the tax law.

  62. Card 62

What is 'Strafrecht' and what is its main source?

Strafrecht (criminal law) consists of rules that define which actions are punishable (misdrijven) and what penalties apply to them. It is also referred to as material criminal law, and its main source is the Strafwetboek (Criminal Code).

  63. Card 63

Define 'Strafprocesrecht' and explain its purpose.

Strafprocesrecht (criminal procedural law), also known as strafvorderingsrecht or formal criminal law, comprises the rules concerning the prosecution and punishment of criminal acts. Its purpose is to regulate how a criminal procedure unfolds, from investigation to sentencing.

  64. Card 64

What are the three essential elements that must be proven to constitute a 'misdrijf'?

To constitute a misdrijf (crime), three elements must be proven: a material element (a punishable act must have been committed), a moral element (the perpetrator must have committed the act intentionally, though this doesn't apply to individuals with mental illness), and unlawfulness (the punishable act must be attributable to the perpetrator, not committed in self-defense or a state of necessity).

  65. Card 65

Explain the 'legaliteitsbeginsel' in strafrecht and its implications for punishment.

The legaliteitsbeginsel (principle of legality) in strafrecht means that one can only be punished for acts explicitly defined as misdrijven in the law, and with penalties expressly determined by law. This principle is encapsulated in the phrases 'Pas de crime, pas de peine sans loi' and 'nullum crimen nulla poena', ensuring legal certainty and preventing arbitrary punishment.

  66. Card 66

How is the interpretation of criminal law handled, especially in cases of doubt?

Criminal offenses must be interpreted strictly. In cases of doubt, the interpretation must be in favor of the accused (the perpetrator). This principle ensures fairness and protects the rights of the defendant.

  67. Card 67

Distinguish between 'overtreding', 'wanbedrijf', and 'misdaad' in terms of severity and competent court.

Overtreding (infraction) is the lowest category of offense (e.g., traffic violations), handled by the politierechtbank. Wanbedrijf (misdemeanor) is a more serious offense (e.g., theft, rape without death), tried by the correctionele rechtbank in the first instance and the hof van beroep on appeal. Misdaad (felony) is the highest category (e.g., murder), handled by the Hof van assisen with a jury, and its rulings cannot be appealed.

  68. Card 68

Explain the concepts of 'gecorrectionaliseerde misdaden' and 'gecontravenaliseerde wanbedrijven' and their purpose.

Gecorrectionaliseerde misdaden are felonies that are reduced to the level of a misdemeanor due to mitigating circumstances, allowing them to be tried by the correctionele rechtbank. Gecontravenaliseerde wanbedrijven are misdemeanors reduced to the level of an infraction due to mitigating circumstances, leading to their trial by the politierechtbank. Both practices aim to alleviate the workload of higher courts.

  69. Card 69

What is the role of the 'Openbaar Ministerie' (OM) in a criminal case, particularly regarding the 'monopolie van de strafvordering'?

The Openbaar Ministerie (OM), or Parket, represented by the Procureur des Konings, holds the 'monopolie van de strafvordering'. This means the OM decides whether a crime will be prosecuted or not. If prosecution is not pursued, it is called a 'sepot'. The OM also leads the process and is responsible for presenting evidence.

  70. Card 70

Describe the two main phases of a criminal case and what happens during each.

A criminal case typically involves an 'onderzoeksfase' (investigation phase) and a 'vonnisfase' (sentencing phase). During the investigation phase, an opsporingsonderzoek (led by the Procureur des Konings) and a gerechtelijk onderzoek (led by an onderzoeksrechter) take place, potentially involving provisional detention or coercive measures. The vonnisfase involves the actual trial and the pronouncement of a verdict by the competent court (Politierechter, correctionele rechtbank, or Hof van Assisen).

  71. Card 71

What is 'Gerechtelijk privaat recht' and why is it considered public law despite its name?

Gerechtelijk privaat recht, or privaatrechtelijk procesrecht, consists of rules concerning the organization and competence of private law courts, as well as the conduct of private law proceedings. It is considered public law because the state organizes and oversees the administration of justice.

  72. Card 72

Explain the principle of 'verbod van rechtsweigering' in judicial private law.

The 'verbod van rechtsweigering' (prohibition of refusal of justice), as stated in Article 5 of the Gerechtelijk Wetboek, means that a judge, if competent, must make a ruling and cannot refuse to do so, for example, because they find a case unpleasant. Article 6 further specifies that a judge must not make generalizations but must consider each case individually, taking into account its specific circumstances.

  73. Card 73

What is the 'dubbele aanleg' principle in judicial proceedings, and what are its exceptions?

The 'dubbele aanleg' (double instance) principle means that, in principle, one can appeal against any judicial ruling. However, there are two exceptions: one cannot appeal against a ruling by the Hof van Assisen, and one cannot appeal against rulings by the vrederechter for amounts under 2000 euros.

  74. Card 74

What is 'Internationaal privaat recht' (IPR) and how does it function in situations with foreign elements?

Internationaal privaat recht (IPR) applies to private law situations involving foreign elements, such as a marriage between individuals of different nationalities living in a third country who wish to divorce. IPR contains 'verwijzingsregels' (referral rules) that determine which court is competent and which national law should be applied, rather than directly resolving the dispute itself.

  75. Card 75

Why do international and supranational rules have absolute priority over national law?

International and supranational rules have absolute priority over national law because of the hierarchy of legal sources. This means that agreements between states (treaties) and laws created by supranational bodies like the EU (e.g., regulations, directives) take precedence over national legislation, ensuring consistency and adherence to international commitments.
